1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

1.2 "Customer", "you" and "your" means the individual, business or organisation that requests and/or pays for our services.

1.4 "Waste" or "Rubbish" means the items, materials, goods, debris, litter, and other substances that you ask us to remove and that we agree we can lawfully collect, transport and dispose of.

1.5 "Booking" means any request for Services that is made by telephone, email, online form, or in person and is accepted by us, whether confirmed verbally or in writing.

2. Scope of Services

2.1 We provide waste collection and rubbish clearance services for domestic, commercial and other properties. This can include removal of general household rubbish, garden waste, office waste, light construction debris and similar non-hazardous materials, subject to applicable regulations.

2.2 We reserve the right to refuse to collect any items or materials that in our opinion are hazardous, restricted, unlawful to transport or dispose of, unsafe for our team to handle, or which fall outside the agreed scope of Services. This may include, without limitation, asbestos, clinical waste, medical sharps, certain chemicals, pressurised containers, gas bottles, and any other specialist or dangerous waste.

2.3 Where special arrangements are required for certain types of waste, additional charges may apply. We will notify you of any such charges before proceeding, wherever reasonably possible.

3. Booking Process

3.1 You can request a rubbish clearance or waste collection service by contacting us by phone, email or via our online booking channels. At the time of booking, you will be asked to provide details including, but not limited to:

a) Your full name and contact details.
b) The address where the waste is to be collected.
c) A description and, where possible, approximate volume or weight of the waste.
d) Any access restrictions or parking requirements.
e) Your preferred date and time for the collection.

3.2 Any quote provided at the time of booking is based on the information you give us. If, when we arrive on site, the actual volume or nature of the waste differs materially from your description, we may adjust the price accordingly. In such circumstances, we will inform you of the revised price before commencing work.

3.3 Bookings are considered confirmed when we have accepted your request and you have agreed to the quoted price and any applicable terms, verbally or in writing. We may, at our discretion, require a deposit to secure the booking.

3.4 We aim to arrive within the agreed appointment window but do not guarantee specific arrival times. Times given are estimates and may be subject to traffic, weather and operational factors. We will use reasonable endeavours to notify you of any significant delays.

4. Access and Parking

4.1 You must ensure that our team has safe and reasonable access to the property or site where the waste is located. This includes ensuring that any gates, doors, lifts or security arrangements allow entry at the agreed time.

4.2 You are responsible for arranging any necessary parking permissions, suspensions or permits. Where parking charges apply, you may be required to cover these costs. If our vehicle cannot be parked safely and legally within a reasonable distance of the site, we may be unable to complete the job or may need to charge additional fees for the extra time and labour involved.

4.3 If we are unable to carry out the Services due to lack of access or parking, our standard cancellation or call-out charge may apply.

5. Customer Responsibilities

5.1 You must ensure that the waste intended for collection is clearly identified and separated from any items that are not to be removed. We will not be liable for the removal of items that were not intended for disposal if they were not clearly segregated.

5.2 You must inform us in advance of any potentially hazardous materials or any items that could cause injury or damage during handling, loading or transport.

5.3 Children, pets and other persons must be kept away from the working area while our team is carrying out the Services, to ensure health and safety.

6. Pricing and Payment

6.1 Our charges are generally based on the volume and type of waste collected, the labour required, and any additional services or fees such as congestion or parking charges. We will communicate the basis of our pricing to you at the time of booking or upon arrival before work begins.

6.2 Unless otherwise agreed, payment is due in full on completion of the job. We may accept payment by cash, debit or credit card, bank transfer, or other agreed methods.

6.3 For business customers and account holders, payment terms may be agreed separately and confirmed in writing. If no separate arrangement is agreed, payment is due on completion.

6.4 All prices are quoted exclusive of any applicable taxes unless stated otherwise. Where applicable, VAT or other taxes will be added at the prevailing rate.

6.5 We reserve the right to charge interest on overdue amounts at the statutory rate, accruing daily from the due date until payment is made in full, as well as any reasonable costs incurred in recovering the debt.

7. Cancellations, Rescheduling and Waiting Time

7.1 You may cancel or reschedule your booking by giving us as much notice as reasonably possible.

7.2 If you cancel less than 24 hours before the scheduled appointment, we reserve the right to charge a late cancellation fee, which may be up to a reasonable proportion of the quoted job value to cover our administrative and operational costs.

7.3 If, on arrival at your property or site, we are unable to proceed with the job due to reasons beyond our control, including but not limited to lack of access, unsafe conditions, or absence of an authorised person to confirm the waste to be removed, we may charge a call-out or waiting fee.

7.4 If you are not present at the time of collection, you must provide clear instructions and ensure that we have authority to access and remove the agreed waste. We will not be liable for any misunderstanding or dispute arising from a lack of on-site supervision where you have given us permission to proceed.

8. Waste Handling and Regulations

8.1 We will handle, transport and dispose of waste collected in accordance with applicable UK waste management regulations and environmental legislation.

8.2 We will use only authorised and licensed facilities for the treatment, recycling or disposal of your waste, where required by law. We will endeavour to maximise recycling and recovery where practicable.

8.3 You confirm that you are entitled to dispose of the waste and that the waste does not include any materials that may be unlawful for us to handle or transport without special permits or licences.

8.4 If we discover regulated or hazardous materials among the waste that were not disclosed at the time of booking, we may refuse to remove them, charge additional fees for handling them, or require you to arrange separate specialist disposal. We will discuss the options with you where reasonably possible before proceeding.

9. Liability and Damages

9.1 We will exercise reasonable care and skill in providing our Services. However, we will not be responsible for any pre-existing damage to your property, fixtures, fittings or belongings.

9.2 You must notify us of any damage you believe has been caused by our team as soon as reasonably possible and in any event within 48 hours of completion of the job. We may require evidence, including photographs and a written description of the incident.

9.3 Our liability for any direct loss or damage arising from our Services shall, to the fullest extent permitted by law, be limited to the total price paid or payable by you for the specific job in question.

9.4 We shall not be liable for any indirect, consequential or economic loss, including but not limited to loss of profit, loss of business, loss of opportunity or loss of use, whether arising from negligence, breach of contract or otherwise.

9.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to limit or exclude liability.

10. Insurance

10.1 We maintain appropriate insurance cover for our rubbish clearance and waste collection operations, including public liability insurance to a level we consider reasonably adequate for the nature of our Services.

10.2 Our insurance does not cover items that you have not clearly identified as waste for removal. You should ensure that any valuable or sensitive items are removed from the working area before our team arrives.

11. Complaints and Dispute Resolution

11.1 If you are unhappy with any aspect of our Services, please contact us as soon as possible so that we can try to resolve the issue promptly.

11.2 We will investigate your complaint and respond within a reasonable timeframe. Where appropriate, we may offer to re-attend, provide a partial refund, or take other remedial action at our discretion.

11.3 If a dispute arises that cannot be resolved directly between us, you and we agree to attempt to resolve the matter through negotiation before considering formal legal proceedings.

12. Force Majeure

12.1 We shall not be liable for any delay in performing, or failure to perform, our obligations under these Terms and Conditions if such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include extreme weather, natural disasters, strikes, road closures, accidents, public emergencies and similar events.

12.2 In such circumstances, we will use reasonable endeavours to notify you and to perform our obligations as soon as reasonably practicable.

13. Privacy and Data Protection

13.1 We collect and process personal data necessary to manage your booking, provide our Services and handle payments and communications. This may include your name, contact details, property address, and payment information.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. Entire Agreement

16.1 These Terms and Conditions, together with any quote or confirmation of booking issued by us, constitute the entire agreement between you and us relating to the provision of our rubbish clearance and waste collection services.

16.2 You acknowledge that you have not relied on any statement, promise or representation made or given by or on behalf of us that is not set out in these Terms and Conditions.
